Residency Requirements

In order to file for a divorce in Nebraska, residency requirements must be met for the court to accept the case.

Nebraska Family Law states that action for divorce may be brought if:

  • The marriage occurred in Nebraska, and either party has resided within the state since marriage, or
  • Either spouse has been a bona fide resident of the state of Nebraska for at least one year before the commencement of the divorce action.
